Law and Ethics for Psychiatric Nursing

Description

This module will acquaint the student with the legal structures which will frame their professional practice. The module examines the regulatory influences on safe practice. Particular emphasis is placed on Mental Health and Capacity legislation including the significance of service users rights. Ethical principles, values and virtues for practice in mental health working will be explored and evaluated.

Learning Outcomes

  1. articulate the content and significance of the statutory framework which frames the professional practice of nursing with particular reference to The Nursing and Midwifery Act, 2011; The Mental Health Act, 2001 and The Assisted Decision Making (Capacity) Act, 2016.

  2. comprehensively describe the regulatory function of The Nursing and Midwifery Board of Ireland; including the objectives and process of the fitness to practice procedure and the grounds on which a referral may be made to the Fitness to Practice Committee and the sanctions which may be imposed following an adverse finding.

  3. evince the sources of service users rights and articulate how these rights can be evidenced in professional practice paying particular attention to the legal and ethical concerns with regard to the use of restraint and seclusion.

  4. consider and articulate the evidence of discrimination against those who have a mental illness and explain any legal remedies which are available to those who are subject to discrimination based on their mental health.

  5. evaluate the relevant knowledge from ethical theory and apply to moral challenges in mental health nursing practice.

  6. evaluate ethical principles and apply to practice and to identify and understand poor professional practice, challenge unprofessional behaviour and report abuse.

  7. have a critical awareness of the role of the mental health nurse in social justice and to evaluate ways of working to avoid discriminatory practice.

  8. critically discuss the legal and ethical considerations of multi-professional collaboration in relation to positive risk taking and safety in recovery orientated care.
