Legal and Accountable Nursing Practice

Description

This module will acquaint the student with the legal structures which will frame his/her professional practice. The module examines the regulatory parameters on safe practice. Particular emphasis is placed on the regulatory function of The Nursing and Midwifery Board and the Health Information and Quality Authority as well as the broader common law rules.

Learning Outcomes

  1. articulate the content and significance of the statutory framework which shapes the professional practice of nursing with particular reference to The Nursing and Midwifery Act, 2011,The Assisted Decision Making (Capacity) Act, 2015, and The Health Act, 2007 (as amended) and the General Data Protection Regulation and be able to apply legislation to relevant to clinical practice.

  2. comprehensively describe the regulatory function of The Nursing and Midwifery Board of Ireland; including its objectives and processes, and develop an awareness of the legal expectation of professional behaviour.

  3. articulate a critical awareness of all elements of the legal framework which hold the professional nurse to account including the role of the criminal law and tort law.

  4. explain and evaluate the role and function of the Health Information and Quality Authority, and assess its impact on patient safety and patient rights.

  5. evince the sources of patients rights and have a critical awareness of legal concepts of equality and social justice and understand the Medico-legal aspects of competence assessment and capacity.
